Personal Data Protection Law Officially Enacted, Institutions Still Working On It
Jakarta, CNBC Indonesia –The Personal Data Protection Law (UU PDP) comes into effect today (17/10/2024). The regulation was enacted after being enacted in 2022.
“The 17th means that the crisis period is over, so the PDP law is in full effect,” said the Director General of IKP, Ministry of Communication and Information, Hokky Situngkir when met in Jakarta, Thursday (17/10/2024).
Meanwhile, the institution that oversees personal data is still being drafted. Hokky explained that he was still waiting for harmonization for the rules to form the institution.
Regarding the enforcement of the regulation, Hokky explained that it had been carried out. According to his confession, there have been several cases of prosecution to the closure of access, but he did not detail the cases.
“There is a transition period that we use to mature the RPP and presidential regulation for the institution and we are still waiting now,” he explained.
The Institute for Policy Research and Advocacy (ELSAM) assessed that without the PDP institution it would be difficult to implement the rules in the law. This is because the institution is the key to enforcing compliance with standards and obligations to protect personal data.One thing that the institution can do is to ensure protection for the rights of data subjects.
According to ELSAM, the institution is ideally an independent authority. However, it is also necessary to be aware of the political process that ultimately places the institution as a government agency.
“Therefore, ideally this institution is designed as an independent authority, both in terms of position, institution, duties and functions, and budgeting,” ELSAM explained.
“However, the political process in the discussion of the PDP Law has placed this institution as part of a government institution, as emphasized in Article 58 of the PDP Law, which states that the government plays a role in organizing PDP, through the establishment of an institution that is appointed and responsible to the President,” ELSAM added.
